    During this 3-hour Law and Ethics presentation CAMFT Staff Attorney, Sara Jasper, will describe key issues to address at the outset of treatment with a particular emphasis on the importance of identifying the patient unit of treatment and setting up reasonable expectations within the patient unit. Ms. Jasper will talk about how this can be achieved through a discussion of patient goals, clarification of professional boundaries and competencies as well as key policies and procedures. Ms. Jasper will cover the No Surprises Act and how to discuss Medicare with patients now that LMFTs (and LPCCs) are Medicare eligible. Finally, Ms. Jasper to discuss additional issues to consider when treating patients with disabilities. The legal and practical information covered will help clinicians comply with their Americans with Disabilities (ADA) responsibilities.

    The workshop will also address some of the most complex reporting issues therapists face, including: distinguishing between lawful vs. unlawful corporal punishment, when / whether to report consensual sexual activity with and between minors, and how CANRA’s mandated reporting rules apply to sexting between minors.

    Educational Goals

      Participants will come away from the presentation with legal and ethical information about how to effectively communicate and collaborate with patients at the outset of the therapeutic relationship. Participants can use what they learn to create clarity, for themselves and their patients, about the goals of the therapeutic relationship, professional boundaries, competencies and key policies and procedures.

        Measurable Learning Objectives

        Upon completion of this workshop, attendees will be able to:

        • Identify fundamental issues to raise when establishing therapeutic relationships
        • Identify the types of professionals and entities who/that must comply with the No Surprises Act (NSA) and the good faith estimate regulations.
        • Describe the requirements for good faith estimates
        • Develop policies and practices that comply with the NSA and the regulations related to good faith estimates.
        • Use practical ideas and tips for how to address the topic of Medicare with patients.
        • Recognize and respond appropriately to legal requirements when establishing therapeutic relationships with clients who have communication disabilities.
        • Identify the five categories of child abuse California mandated reporters are required to report

              About the Presenter

              A member of the State Bar of California since 2008, Sara Jasper, Esq. joined CAMFT as a Staff Attorney in 2011. Before coming to CAMFT, she worked as the Legal Liaison and Administrative Officer for the Sacramento Police Department and as an Associate at Middleton, Young & Minney, LLP where she practiced education and employment law. During law school, Sara clerked for the California Judicial Council, Center for Children, Families and the Courts and for the National Center for Youth Law. Since joining CAMFT, Sara has become a Certified Association Executive and earned her certificate in Nonprofit Organization Management. As a CAMFT staff attorney, Brad takes member phone calls regarding law and ethics issues and contributes articles on those subjects to CAMFT's publication, the Therapist. Prior to joining CAMFT’s legal team, Brad worked on litigation and regulatory matters as an attorney for San Diego Gas & Electric Company.

              Motherhood is loaded with fantasies and expectations of how our children will fulfill our dreams and meet our own emotional needs. As mothers’ systems encounter the inevitable disappointments and losses inherent to the role, they often attribute those losses to their own failures and shortcomings: there’s something wrong with me, I’m not good enough, this is so embarrassing, etc. In our culture of perfectionistic mothering, moms’ Protector parts choose to exile and silence their losses and shame, out of fear of humiliation and rejection. When grief and shame are exiled, moms experience themselves as disordered. Protective parts band together to try to create a “good mom” facade, paradoxically confirming “bad mom” feelings. Maternal losses and grief re-kindle and stoke the flames of old shame fires. Grief and shame are Inescapable Vulnerabilities in motherhood.

              In this workshop we will teach participants how to implement aspects of our unique adaptation of Internal Family Systems, called “The Mom Parts Method.” Mom Parts guides mothers through a process of identifying and naming both grief and shame in ways that open up self-compassion and inner trust. Ways of understanding and being with grief and shame will be explored, enabling participants to confidently escort clients closer to the root of their pain. It may be cliche to say “we need to feel to heal,” but the truth is that all moms experience these Inescapable Vulnerabilities and most moms don’t know how to metabolize them. Participants will have an experiential opportunity to explore their own Inescapable Vulnerabilities and how their own parts may prevent them from being with their clients’ grief and shame in session.

              Program Goals

              The goal of this workshop is to depathologize the presence of grief and shame in motherhood and to embolden and equip participants to move closer to these inescapable vulnerabilities that all moms experience. By implementing the Internal Family Systems concept of “parts”, participants will be able to identify predictable ways moms attempt to protect their vulnerability, and support mothers in accessing more of what IFS calls “Self-energy” as a healing agent.

              Learning Objectives

              At the end of the presentation, attendees will be able to...

              • Identify three or more ways that mothers inevitably experience loss.
              • Explain at least two defining features of shame that distinguish it from both guilt and grief.
              • Identify at least two experiences that grief and shame require, in order to heal.

                    About the Presenters

                    Rebecca Geshuri (left) and Jessica Sorci are both Licensed Marriage and Family Therapists, Certified Internal Family Systems Therapists and also Perinatal Mental Health Certified. As Co-Founders of Family Tree Wellness in Silicon Valley, California, Rebecca and Jessica lead their one-of-a-kind IFS-informed group psychotherapy practice that provides counseling, education and support for people who are in the family building phase of life. They are wildly enthusiastic about supporting other therapists who want to deepen their knowledge and skill with using IFS and working in Reproductive Mental Health. Their comprehensive Mothercentric Approach is being integrated into a book called MOM PARTS, and is currently being offered annually, alongside Mom Parts Salons and a Mothercentric Continuum consultation group. Most importantly, Rebecca and Jessica are mothers who bring their own personal experiences with grief and growing, mixed with creative expression and spirituality to their work. Their goal is nothing short of healing humanity's intergenerational burdens.

                    The incidence of suicide, statistical and demographic data, avoiding liability, standards of care; identifying risk factors for suicide and undertaking reasonable protective actions, the “Zero Suicide Model,” relevant exceptions to confidentiality, relevant ethical standards and issues involving documentation.

                    The workshop will discuss key issues involved when working with dangerous clients, including:
                    Standards of care, the “duty to protect” based upon Tarasoff v. Regents of Univ. of Calif., (1976) and Civil Code §43.92, the meaning of “patient communication” based upon Ewing v. Goldstein, Ph.D. (2004) and Ewing v. Northridge Hospital Center, (2004), the “duty to report,” based upon Welfare and Institutions Code §8100(b)(1) and §8105(c), and relevant exceptions to confidentiality.

                            During this three (3) hour presentation, CAMFT Staff Attorney Alain Montgomery, JD will examine issues related to rendering mental health services via telehealth to help providers adopt sound legal and ethical practices around the use of telehealth. The workshop will review the legal standards of practice for telehealth and review sections in the CAMFT Code of Ethics that address telehealth best practices. Additional topics include matters related to rendering services to clients via telehealth who are physically located in other states and/or other countries and discuss the technical safeguards that protect client information when using videoconferencing technology.

                              • Identify the preliminary and ongoing requirements to initiate when providing mental health services via telehealth;
                              • Determine when it is lawful to render mental health services via telehealth to a client who is not physically located in the state of California; and,

                                    Alain Lance Montgomery, Esq., is a member of the State Bar of California. Alain received a Bachelor of Arts degree in Political Science from the University of California at Berkeley and a Juris Doctor degree from Thomas Jefferson School of Law. Prior to joining the CAMFT legal department, Alain worked in public interest law as a legal advisor for the Superior Court of California where he helped self-represented parties navigate the complexities of small claims litigation. As a member of the CAMFT legal department, Alain has served as part of the support staff for the CAMFT Ethics Committee and has represented the Association at various state regulatory board meetings. After graduating from college and before attending law school, Alain worked as a ski instructor at Mammoth Mountain Ski Resort.

                                    As we enter the holiday season, there is no gift less desired by a therapist than being served with a subpoena. In this three-hour webinar, attendees will learn the purpose of different types of subpoenas, how to digest a subpoena, steps to take in responding to a subpoena, and the role of the psychotherapist-patient privilege.

                                      Upon completion of this workshop, attendees will be able to:

                                      • Analyze a subpoena to determine who issued the subpoena, what type of documents or testimony are requested, and the appropriate next steps in responding to a subpoena seeking records or testimony.
                                      • Identify the holder of the psychotherapist-patient privilege, when it is appropriate for a therapist to assert the psychotherapist-patient privilege on behalf of a patient, and when such an objection is not appropriate.
